CANADA 150 RINK/Hockey on the HILL Contest

 

THIS CONTEST IS GOVERNED BY CANADIAN LAW

  1. SPONSOR:

 

The Canada 150 Rink/Hockey on the Hill contest (the “Contest”) is sponsored by the Ottawa International Hockey Festival (the “Sponsor”).

 

  1. ELIGIBILITY RULES:

 

  1. Team Eligibility:

 

To be eligible for this Contest, a Team (each, a “Team” and collectively the “Teams”) must meet all of the following requirements:

 

  1. Must be either: (i) a Peewee house league team registered in a girls’ division for the 2017-2018 winter hockey season (a “Girl Team”); or (ii) a Peewee house league team registered in a boys’ division for the 2017-2018 winter hockey season (a “Boy Team”) [Note: If a Team plays in a league with a tiered system in place, then only tier II and lower Peewee level house league Teams will be eligible for entry. By way of example, Hockey Eastern Ontario uses an A, B, and C tiering system.  Only B and C level Teams registered with Hockey Eastern Ontario will be eligible for entry.];

 

  1. Must be sanctioned by Hockey Canada and registered to play in one (1) of the Regions (each, a “Region” and collectively the “Regions”) outlined in Schedule “A” to these Official Rules and Regulations (the “Rules”);

 

  • Must have between eleven (11) and seventeen (17) eligible Players (each, a “Player” and collectively the “Players”) on the Team’s roster for the 2017-2018 winter hockey season – all of whom must be born after December 31, 2004 and otherwise meet the eligibility requirements outlined below in Rule 2(c);

 

  1. Must have up to five (5) Team Chaperones (each, a “Chaperone”) who are willing and able to travel to and from Ottawa, Ontario between December 27, 2017 through December 31, 2017;

 

  1. Must be represented by a Designated Entrant (a “Designated Entrant”) who meets the eligibility requirements outlined below in Rule 2(b); and

 

  1. Must not have any Team officials (including, but not limited to, the Designated Entrant) who are an employee, representative or agent [or an immediate family member (defined for the purposes of these Rules as: spouse, mother, father, brother, sister, son and/or daughter, whether or not they reside in the same household) or domiciled with (whether related or not) any such employee, representative or agent] of the Sponsor, the Department of Canadian Heritage, Capital Sports & Entertainment Inc. (the Ottawa Senators Hockey Club), Capital Sports Properties Inc., or Capital Sports Management Inc., or any of their respective agents, affiliates, subsidiaries, related companies, sponsors, advertising or promotional agencies, or assignees, or any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties“).

 

  1. Designated Entrant Eligibility:

 

To be eligible for this Contest, a Team’s Designated Entrant must: (i) be a resident of Canada; (ii) have reached the legal age of majority in his or her province/territory of residence at the time of entry; (iii) be acting as an official of the Team (i.e. a coach, trainer or manager) at the time of entry and during the Contest; and (iv) not be an employee, representative or agent [or an immediate family member (as defined above) or domiciled with (whether related or not) any such employee, representative or agent] of any of the Contest Parties.

 

  1. Player Eligibility:

 

To be eligible for this Contest, a Player must: (i) be a resident of Canada; (ii) be born after December 31, 2004 (iii) be registered to play on his/her Team’s roster for the 2017-2018 winter hockey season; and (iv) be willing and able to travel to and from Ottawa, Ontario between December 27, 2017 through December 31, 2017.

 

NOTE TO PLAYERS: The Sponsor reserves the right, in its sole and absolute discretion, on a random audit basis to contact a Player’s parent/legal guardian for the purposes of verifying his/her: (i) consent to the Player’s participation in this Contest; (ii) consent to the collection, use and disclosure of the Player’s personal information; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.   Failure of a Player’s parent/legal guardian to complete any such required verification to the complete satisfaction of the Sponsor within the time frame specified by the Sponsor may, in the sole and absolute discretion of the Sponsor, result in disqualification of the Player from participating in the Contest.

 

IMPORTANT NOTE: At any point during or after the Contest (including, but not limited to, after Prizes have been awarded), the Sponsor reserves the right, in its sole and absolute discretion, to require proof, in form and substance satisfactory to the Sponsor (including, but not limited to, requiring the Designated Entrant to sign a legally binding agreement), that: (i) the Designated Entrant meets the eligibility requirements specified in these Rules; (ii) the Team meets the eligibility requirements specified in these Rules; (iii) each Player on the Team meets the eligibility requirements specified in these Rules; (iv) neither the Designated Entrant, Team, any Player on a Team, nor any parent/legal guardian or other individual associated with the Team in any way has, to the knowledge of the Designated Entrant, violated these Rules (as determined by the Sponsor in its sole and absolute discretion); (v) the Designated Entrant has obtained from the parent or legal guardian of each Player on his/her Team an acknowledgement that the Designated Entrant has the legal right to: (a) enter the Contest on behalf of the Team; (b) agree to be legally bound by these Rules on behalf of the Team; and/or (c) consent to the storage, usage and sharing of any personal information submitted for purposes of administering the Contest; and/or (vi) is required for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.

 

  1. KEY DATES:

 

The Contest begins on Friday, October 27, 2017 at 9:00 a.m. Eastern Daylight Time (“EDT”) and ends on Saturday, November 18, 2017 at 11:59 p.m. Eastern Standard Time (“EST”) (the “Contest Period”).

 

 

 

  1. AGREEMENT TO BE LEGALLY BOUND BY RULES:

 

By participating in this Contest, each Designated Entrant is signifying his/her agreement that he/she has read and agrees to be legally bound by these Rules.

 

  1. HOW TO ENTER:

 

NO PURCHASE NECESSARY.  MAKING A PURCHASE WILL NOT INCREASE OR OTHERWISE IMPACT YOUR CHANCES OF WINNING IN THIS CONTEST.

 

To be eligible to earn one (1) Entry (each, an “Entry” and collectively, the “Entries”) in the Contest, a Team’s Designated Entrant must complete all of the following steps:

 

  1. Go to canada150rink.com/contest (the “Website”) and obtain the Official Contest Entry Form (the “Entry Form”);

 

  1. Fully complete the Entry Form with all required information – which includes (among other things) a requirement to: (i) enter the Designated Entrant’s personal contact information; (ii) identify the Designated Entrant’s official role on the Team; and (iii) provide certain Team registration information – including, but not limited to: identifying whether or not the Team is a Girl Team or a Boy Team; providing the number of Players contained on the Team’s Hockey Canada sanctioned roster; identifying the Team’s Region; and identifying the name of the Team’s local hockey association;

 

  1. Follow the on-screen prompts to submit the following materials:

 

  1. Essay: The Designated Entrant must submit one (1) unique and original Essay (the “Essay”) that he/she feels best highlights why his/her Team deserves to represent its Region in the 2017 Bell Capital Cup’s ‘Canada 150 Division’;

 

and

 

  1. Video: The Designated Entrant must submit a link to one (1) unique and original Video (the “Video”) in support of his/her Essay demonstrating why his/her Team deserves to represent its Region in the 2017 Bell Capital Cup’s ‘Canada 150 Division’.

 

IMPORTANT NOTE: The Video upload process will take place via YouTube.  The Entry Form will include instructions for creating a YouTube account, uploading an unlisted video, and sharing the Video’s URL on the Entry Form in order to submit the Video as part of the Entry.

 

The Contest is in no way sponsored, endorsed or administered by, or associated with YouTube.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to YouTube. 

 

  1. Formally signify his/her agreement that he/she has read and agrees to be legally bound by these Rules.

 

When all required steps of the entry process are complete (including fully completing the Entry Form, agreeing to the Rules and uploading the Essay and Video), the Designated Entrant must follow the on-screen instructions to submit the Entry.  No entries will be accepted by any other means.

 

To be eligible, all content and materials associated with a Designated Entrant’s Entry (collectively, the “Entry Materials”) must: (i) be submitted and received in accordance with these Rules during the Contest Period; (ii) include all required components and materials noted above; and (iii) be in accordance with these Rules, including, but not limited to, the specific Submission Requirements listed below in Rule 9 (all as determined by Sponsor in its sole and absolute discretion).

 

Without limiting the generality of the foregoing, the Video must also comply with the YouTube Community Guidelines (available at: https://www.youtube.com/yt/policyandsafety/communityguidelines.html).   Any Video that does not comply with the YouTube Community Guidelines will be disqualified (which will also result in disqualification of the associated Entry).

 

For greater certainty and the avoidance of any doubt, the Designated Entrant must be authorized at the time of entry (and must remain authorized during and after the Contest Period) by the Team and each Player (and his/her parent or legal guardian) on the Team to: (i) provide to Sponsor any and all required information that relates to the Team and/or the Player for the purposes of administering the Contest in accordance with these Rules; and (ii) enter the Contest on behalf of the Team.

 

  1. VERIFICATION:

 

The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, but not limited to, government-issued photo identification): (i) for the purposes of verifying the eligibility of any Designated Entrant, Team and/or Player to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry, Entry Materials and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.  Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor.  The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) of the Sponsor.

 

  1. ENTRY LIMIT:

 

A Designated Entrant can only enter one (1) Team into the Contest. For greater certainty and the avoidance of any doubt, this means that the same Designated Entrant cannot represent or submit an Entry on behalf of more than one (1) Team in this Contest. Further, a Team can only be entered into the Contest one (1) time.  Only the first eligible Entry submitted on behalf of the Team by a Designated Entrant will be accepted.  No Team may have more than one (1) Entry and any subsequent Entry/Entries submitted by or on behalf of a Team will automatically be disqualified and considered null and void.

 

  1. ADDITIONAL ENTRY RULES:

 

If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use multiple names, multiple identities, multiple email addresses, any automated, macro, script, robotic or other system(s) or program(s) and/or any other means not in keeping with the Sponsor’s interpretation of the letter and spirit of these Rules to enter or otherwise participate in or to disrupt this Contest; then the Sponsor reserves the right, in its sole and absolute discretion, to take whatever action it deems necessary based on the circumstances to help ensure that the Contest is being conducted in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.

 

The Contest Parties, Google Inc., and each of their respective agents, employees, officers, directors, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Entries and/or Entry Materials (all of which are void).

 

An Entry may be rejected if, in the sole and absolute discretion of the Sponsor: (i) the Entry (including, but not limited to, any associated Entry Materials) is not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) the Entry Materials accompanying the Entry are not in full compliance with these Rules (including, but not limited to, the specific Submission Requirements listed below in Rule 9) (all as determined by Sponsor in its sole and absolute discretion).

 

In the event of a dispute regarding who submitted an Entry, the Sponsor reserves the right, in its sole and absolute discretion, to deem the Entry to have been submitted by the authorized account holder of the email address submitted at the time of entry.  “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A Designated Entrant may be required to provide proof (in a form acceptable to the Sponsor – including, but not limited to, government issued photo identification) that he/she is the authorized account holder of the email address associated with the Entry in question.

 

  1. SUBMISSION REQUIREMENTS:

 

BY SUBMITTING AN ENTRY, THE DESIGNATED ENTRANT AGREES THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, BUT NOT LIMITED TO, THE ENTRY MATERIALS) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF ANY ENTRY (OR ANY COMPONENT THEREOF – INCLUDING, BUT NOT LIMITED TO, THE ENTRY MATERIALS); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND/OR DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, ANY PRIZE (INCLUDING ANY USE OR MISUSE OF A PRIZE).  THE RELEASED PARTIES SHALL BE HELD HARMLESS BY A DESIGNATED ENTRANT IN THE EVENT IT IS DISCOVERED THAT HE/SHE HAS DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZES.

 

To be eligible for entry in this Contest, the Entry Materials submitted by a Designated Entrant must meet the following requirements:

By participating in the Contest, each Designated Entrant hereby warrants and represents that any Entry Materials he/she submits:

 

  1. are original to him/her and that the Designated Entrant has obtained all necessary rights in and to the Entry Materials for the purposes of entering such Entry Materials in the Contest;

 

  1. do not violate any law, statute, ordinance or regulation;

 

  • do not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence;

 

  1. will not give rise to any claims whatsoever, including, but not limited to, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and

 

  1. are not defamatory, trade libelous, pornographic or obscene, and further that they will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; content that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of any individual (unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence); commercial messages, comparisons or solicitations for products or services; any identifiable third party products, trade-marks, brands and/or logos (other than those for which all rights have been properly cleared by the Designated Entrant for use in relation to his/her Entry Materials for the purposes of this Contest); conduct or other activities in violation of these Rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

 

The Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) reserves the right, but does not have the obligation, to screen all Entry Materials.   Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification.  The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to remove any Entry Materials (or any part thereof) in order to ensure that the Entry Materials comply with these Rules, or for any other reason.   If such an action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, but not limited to, disqualifying the Entry Materials (and therefore the corresponding Entry and/or the associated Designated Entrant) – to help ensure that the Contest is being conducted in accordance with the Sponsor’s interpretation of the letter and spirit of these Rules.

 

  1. GRANT OF RIGHTS:

 

By entering the Contest and submitting an Entry, each Designated Entrant: (i) grants to the Sponsor, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Entry Materials (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason; (ii) waives all moral rights in and to his/her Entry Materials (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry Materials); and (iii) agrees to release and hold harmless the Sponsor and all of the other Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry Materials (or any component thereof), including, but not limited to, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.

 

  1. PRIZES:

 

There will be a total of thirty-two (32) Prizes (each, a “Prize” and collectively, the “Prizes”) available to be won.  There will be two (2) Prizes available to be won per Region.  In each Region, there will be: (i) one (1) Prize available for a Girl Team; and (ii) one (1) Prize available for a Boy Team – with the goal being to create a Girls’ Canada 150 Division of sixteen (16) Girl Teams and a Boys’ Canada 150 Division of sixteen (16) Boy Teams for the Bell Capital Cup (the “Tournament”).

 

The nature and value of the Prizes will vary by Region, as follows:

 

  1. Regions (See Schedule “A”): British Columbia; Alberta; Saskatchewan; Manitoba; Southern Ontario; Northern Ontario; Quebec; New Brunswick; Prince Edward Island; Nova Scotia; Newfoundland and Labrador; Yukon; Northwest Territories; and Nunavut.

 

In each of these Regions, each Prize will consist of a trip for the Team designated in the winning Entry to Ottawa, Ontario to participate in the Tournament that is currently scheduled to be held from December 28, 2017 through December 31, 2017 – which includes:

 

  • round trip transportation (economy class – via a mode of transportation selected by the Sponsor in its sole and absolute discretion) for up to seventeen (17) Players on the Team and up to five (5) Team Chaperones* (collectively, the “Prize Participants”) to Ottawa, Ontario from a departure point designated by Sponsor in its sole and absolute discretion;

 

*To be a Chaperone, an individual must have reached the legal age of majority in his/her jurisdiction of residence. A Designated Entrant wishing to participate in the Prize and travel with his/her Team, will be deemed one (1) of the Team’s Chaperones for purposes of the Prize.

 

  • accommodation for the Prize Participants (standard room – number of Prize Participants per room to be determined and designated by Sponsor in its sole and absolute discretion) for four (4) nights in a hotel or hotels determined by Sponsor in its sole and absolute discretion;

 

  • entry for the Team in the Canada 150 Division of the Tournament;

 

  • the opportunity for the Team to play one (1) of its Tournament games on the Canada 150 Rink on Parliament Hill (or on an alternate rink to be selected by the Sponsor in its sole discretion) in Ottawa, Ontario;

 

  • one (1) commemorative Canada 150 / Bell Capital Cup jersey per Player on the Team (sizing subject to availability); and

 

  • select ground transportation for the Prize Participants while in Ottawa.

 

  1. Regions (See Schedule “A”): Ottawa; and Gatineau.

 

In each of these Regions, each Prize will consist of the opportunity for the Team designated in the winning Entry to participate in the Tournament – which includes:

 

  • entry for the Team in the Canada 150 Division of the Tournament;

 

  • the opportunity for Team to play one (1) of its Tournament games on the Canada 150 outdoor rink on Parliament Hill (or on an alternate rink to be selected by the Sponsor in its sole discretion) in Ottawa, Ontario; and

 

  • one (1) commemorative Canada 150 / Bell Capital Cup jersey per Player on the Team (sizing subject to availability);

 

The approximate retail value of each Prize will vary by Region and is listed in Schedule “A” to these Rules.  The actual retail value of each Prize will vary depending on many different factors.  Under no circumstances whatsoever will any difference between the actual and approximate retail values be awarded.

 

Without limiting the generality of the foregoing, the following general conditions apply to each Prize: (i) all Prize Participants must be available to participate in the Prize between December 27, 2017 through December 31, 2017 (otherwise the Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, nothing will be substituted in its place); (ii) Prize must be accepted as awarded and is not transferable, assignable and/or convertible to cash; (iii) no substitutions are permitted, except at Sponsor’s option; (iv) where travel is included in the Prize, all Prize Participants must have all necessary documentation to permit travel and must travel on the same itinerary; (v) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of Prize Participants, including, but not limited to: meals and drinks; gratuities; entertainment; health and other insurance; additional transportation; baggage and other fees; and items of a personal nature (NOTE: one (1) or more of a Team’s Chaperones may be required to present a valid major credit card in his/her name at the time of hotel check-in to cover any incidental expenses); (vi) if any aspect(s) of a Prize are not utilized for any reason, then any such aspect(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater retail value; and (viii) all arrangements relating to the Prize must be made through the Sponsor or its designated agents.

 

Each Prize Participant will be required to sign (and have his/her parent/legal guardian sign if he/she is under the legal age of majority in his/her jurisdiction of residence) and return the Sponsor’s release (by the date indicated on the release form) indicating (among other things) that he/she waives all recourse against the Sponsor and all of the other Released Parties relating to his/her participation in the Prize.

 

IMPORTANT NOTES:

 

  • Sponsor will not involve itself in, and the Released Parties accept no obligation or liability whatsoever in respect of, any decision regarding which Players on a Team and/or Chaperones are permitted to participate in the Prize.

 

  • Should any family member who is not a Prize Participant wish to accompany the Prize Participants, he/she will be solely responsible for all costs associated with doing so and further for making all necessary arrangements required to do so.

 

  • It is strongly recommended and encouraged that all Prize Participants obtain sufficient personal insurance coverage prior to participation in the Prize.

 

The Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of a Prize – including, but not limited to the Tournament.  No individual or entity will be compensated in the event of such delay, cancellation or other event contemplated herein.  The Sponsor will not replace any lost or stolen tickets. Changes to Prize Participants are not accepted once bookings have been confirmed.

 

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each Prize Participant (and his/her parent/legal guardian on his/her behalf if he/she is under the legal age of majority in his/her jurisdiction of residence) understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory.

 

For greater certainty and the avoidance of any doubt, by agreeing to participate in a Prize, each Prize Participant (and his/her parent/legal guardian on his/her behalf if he/she is under the legal age of majority in his/her jurisdiction of residence) hereby agrees to waive all recourse against the Sponsor and all of the other Released Parties if his/her Prize or a component thereof does not prove satisfactory, either in whole or in part.

 

  1. ELIGIBLE WINNER SELECTION PROCESS:

 

For the purposes of eligible winner selection, eligible Entries will be divided by Region as follows: (i) Entries that relate to a Boy Team (each a “Boy Team Entry” and collectively the “Boy Team Entries”); and (ii) Entries that relate to a Girl Team (each a “Girl Team Entry” and collectively the “Girl Team Entries”).

 

A panel of judges (the “Judges”) appointed by the Sponsor will judge each eligible Entry on the basis of the following weighted criteria:

Each Entry will be given a score (the “Score”) by the Judges.  In relation to each Region:

 

  • The Designated Entrant associated with the Boy Team Entry that received the highest Score in the applicable Region (as determined by the Judges, in their sole and absolute discretion) from among all Boy Team Entries in that Region will be the eligible winner of a Prize. Odds of being selected depend on the number and calibre of eligible Boy Team Entries submitted and received in accordance with these Rules in each Region.

 

  • The Designated Entrant associated with the Girl Team Entry that received the highest Score in the applicable Region (as determined by the Judges, in their sole and absolute discretion) from among all Girl Team Entries in that Region will be the eligible winner of a Prize. Odds of being selected depend on the number and calibre of eligible Girl Team Entries submitted and received in accordance with these Rules in each Region.

 

In the event of a tie between two or more eligible Entries based on Score in a Region, the Designated Entrant associated with the eligible Entry – from amongst all such eligible Entries that are tied in the applicable Region – with the highest score on Criteria 1 (followed in the event of a further tie by Criteria 2, then Criteria 3) will be selected as the eligible winner of the applicable Prize.  In the event of an exact tie based on criteria 1, 2, and 3, a new panel of judges will be appointed by the Sponsor to break the tie in accordance with the preceding procedure.

 

In the event that there are no eligible Boy Team Entries in a Region, then there will be no Prize for a Boy Team in that Region.

 

In the event that there are no eligible Girl Team Entries in a Region, then there will be no Prize for a Girl Team in that Region.

 

Judging is scheduled to be completed on or about Sunday, November 19, 2017 (the “Selection Date”).

 

  1. ELIGIBLE WINNER NOTIFICATION PROCESS:

 

In relation to each eligible winning Entry, the Sponsor or its designated representative will make a minimum of three (3) attempts to contact the Designated Entrant associated the Entry within two (2) business days of the Selection Date.  If a Designated Entrant cannot be contacted as outlined above, or if there is a return of any notification as undeliverable; then the applicable Entry may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, the Designated Entrant and Team will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate eligible winning Entry from the applicable Region in accordance with the applicable procedures outlined in Rule 12 (in which case the foregoing provisions of this section shall apply in relation to such newly selected eligible winning Entry).

 

  1. ELIGIBLE WINNER CONFIRMATION PROCESS:

 

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE RULES, EVEN IF SUCH PERSON IS ANNOUNCED AS THE WINNER OR AN ELIGIBLE WINNER.

 

BEFORE BEING DECLARED AS A CONFIRMED PRIZE WINNER, the Designated Entrant associated with each eligible winning Entry must: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return by 5:00 p.m. EST on Friday, November 24, 2017, a declaration and release prepared by the Sponsor, which, among other things: (i) confirms the Designated Entrant’s, Team’s and each Player’s compliance with these Rules; (ii) agrees to release the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from any liability in connection with this Contest and/or the Designated Entrant’s, Team’s and any Player’s participation therein; (iii) agrees to indemnify the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry Materials; (iv) acknowledges acceptance of the Prize (as awarded); (v) releases the Released Parties from any and all liability in connection with this Contest, the Designated Entrant’s, Team’s and any Players’ participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; (vi) agrees to the publication, reproduction and/or other use of his or her name and the Team name, as well as any statements about the Contest and/or photographs or other likenesses without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet; and (vii) agrees to provide the Sponsor with proof (in a form acceptable to the Sponsor, including, but not limited to, by obtaining a signed consent form from each Player and his/her parent/legal guardian) signifying that the Designated Entrant: (a) had the authority (at the time of entry into the Contest) to enter the Contest on behalf of the Team and to submit any required information on behalf of the Team and its Players (as applicable); and (b) now has (and had at the time of entry into the Contest) the authority to legally bind the Team to these Rules and the terms of the declaration and release.

 

If the Designated Entrant associated with an eligible winning Entry: (i) fails to correctly answer the skill-testing question; (ii) fails to return the properly executed Contest documents within the specified time; (iii) cannot accept (or is unwilling to accept) the Prize (as awarded) for any reason; and/or (iv) is determined to be in violation of these Rules at any time (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified and the Designated Entrant and Team will forfeit all rights to the applicable Prize.  In any such case, the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate eligible winning Entry from the applicable Region in accordance with the applicable procedures outlined in Rule 12 (in which case the foregoing provisions of this section shall apply in relation to such newly selected eligible winner).

 

  1. GENERAL CONDITIONS:

 

This Contest is subject to all applicable federal, provincial and municipal laws.  The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal.

 

ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

 

The Released Parties will not be liable for: (i) any failure of the Website and/or any other website or platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, but not limited to, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Entry, Entry Materials and/or other information to be received, captured, recorded or work properly for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to any person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above.

 

The Sponsor reserves the right subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules, including, but not limited to, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever.  Any attempt to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to cancel, amend or suspend this Contest, or to amend these Rules, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.  The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.

 

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with applicable laws.  This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

 

The Sponsor reserves the right, subject only to the approval of the Régie in Quebec, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by Sponsor, for purposes of verifying compliance by any entrant, Entry, Entry Materials and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.

 

For Quebec residents:  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

 

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the French version of these Rules, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by law.

 

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision.  In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

 

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.  The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to this Contest.
